Implementation Measures on the Agreement-based Land Transfer
Article 1 These Measures are hereby formulated to strengthen state-owned land assets management, optimize land resource distribution and regulate agreement-based transfer of state-owned land use right in accordance with the Urban Real Estate Administration Law of the People's Republic of China, Land Management Law of the People's Republic of China, Rules on the Agreement-bases Assignment of State-Owned Land Use Right and Measures of Tianjin on Paid Use of State-owned Land.
Article 2 The fee of the agreement-based land transfer shall be subject to the bottom price of agreement-based transfer.
Article 3 For agreement-based land transfer, the bottom price shall be set first, which shall be subject to the bottom price of the agreement-based transfer. After setting, the bottom transfer price shall be kept confidential without disclosure to any entity and individual.
Article 4 Agreement-based land transfer shall be made according to the following process:
1. The land bureau of the Area shall publish state-owned land use right transfer program to the public at the Land Exchange Center or through newspapers, internet and media. The project attraction authorities shall complete Project Land Transfer Intent Application Form together with the institutional or individual land users and submit the same to Planning and Construction Bureau of the Area. It shall not be less than 30 days from publishing transfer plan to accepting the application.
2. On receipt of Project Land Transfer Intent Application Form, the Planning and Construction Bureau shall provide initial location for the projects in accordance with the planning and industrial policies, and submit the Form to the Management Committee for approval.
3. The Planning and Construction Bureau shall propose planning and designing conditions according to project location approved by the Management Committee.
4. The land bureau of the Area shall commission the qualified assessment units to evaluate the land price of the intended land plot.
5. After verification of the land price evaluation, the land bureau of the Area shall collectively determine and formulate the land transfer scheme and agreement-based bottom price and summit the same to the Management Committee for approval. The agreement-based land transfer scheme shall include specific location, boundaries, purpose, area, term, land use conditions, planning and designing conditions, land supply time, etc. of the land plots to be transferred.
6. On approval of the agreement-based land transfer scheme and agreement-based transfer bottom price by the Management Committee, the land bureau of the Area shall conduct full consultations with the project attraction authorities and the potential land users on the land price etc. The contract shall not be executed until the consultation leads to an agreement and the transfer price is not lower than the agreement-based transfer bottom price.
7.                  On basis of the agreed results, the land bureau of the Area shall enter into State-owned Land Use Right Transfer Contract with the potential land user. Within 7 days after execution of State-owned Land Use Right Transfer Contract, the land bureau shall publish the transfer results at the Land Exchange Center and through newspapers, internet and media and accept social supervision. Such results shall be published for not less than 15 days.
Article 5 On execution of State-owned Land Use Right Transfer Contract, land bureau of the Area together with the project attraction authorities shall urge the land users to pay land transfer fee on time.
Article 6 The land user shall pay transfer amount in full in accordance with State-owned Land Use Right Transfer Contract, process land registration by law and start construction after acquiring state-owned land use certificate.
Article 7 These Measures will go to effect on the date of promulgation.
